EU settlement scheme family permit

EU settlement scheme family permit

Hello,

I am an EU citizen and have been living in the UK. I have Settled status under the EUSS scheme.
My wife also has been living in the UK with me. She also has Settled status under the EUSS scheme. She is an Indian citizen.

My wife delivered a baby in India in the month of October 2025. So, my wife and the child are in India. I was also there in India during the delivery and yesterday arrived to the UK)
My child has Indian nationality.

I want to bring my child to the UK. So, the plan is, my wife will be travelling with the child to the UK. I believe the correct application to do it is the EU Settlement scheme family permit

Q. Can you please correct it, if the EU Settlement scheme family permit is the correct application to bring my child to the UK? Is there any other way to bring the child to the UK?

While filling the form for the EU Settlement scheme family permit, I came across a situation where my wife's country of nationality (India) is not listed in the "Country of nationality" field.

Allowed listed countries are: Austria, Belgium, Bulgaria, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hungary, Iceland, Ireland, Italy, Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Netherlands, Norway, Poland, Portugal, Romania, Slovakia, Slovenia, Spain, Sweden, Switzerland

Since my wife's country of nationality (India) is not listed in the "Country of nationality" field, it does not allow me to put India in the field and hence I can not proceed with the form.

Does that mean the child can not travel to UK with non EU family member or the application form has a bug which does not allow to enter non EU country like India?

Any help is appreciated. Thanks in advance

If an EU family permit is possible, only you can sponsor the child as an EU citizen. Your wife cannot sponsor an EU family permit, if this is even possible.

You may have to go the more expensive route of the child visa under the family route and pay the visa fees and the immigration health Surcharge.


Also, had the child been born in the uk, the child would have been British automatically if one parent had settled status.

Does the child not inherit your EU citizenship by descent as well?

I want to go with EU settlement scheme family permit, Can you please help me to fill the form as my wife's country of nationality which is India is not listed and hence I can not proceed with the form.

I called the EU settlement scheme help desk and they said since it is a family permit, I need to call General Visa department. When I called General Visa department, they said that since it has the name EU settlement Family Permit, I need to call EU settlement scheme help desk. This is going forever

If you child already has also your EU citizenship, you can apply for Settled status for him, just make a new application and link the application to your application (you can inherit your Settled status to your child). You don't need to wait for the approval, the child can come with his pending application because you will get a Certificate of Application which will give him the same rights as yours.
If you don't plan to give your EU citizenship to your child - I think there are two ways then: either you do the same above, but you will have to wait until they give the settled status - it will serve as e-visa when you all enter the UK. But this might take a few months until they approve it.
Or alternatively you can apply for EUSS family permit, so there will be a paper sticker in your child's passport, after that you can enter and apply for the settled status like above. Not sure how long it might take to process it, maybe it is worth just to apply for Settled status straight away and wait until they approve it
