EEA FP Question for current employment

i am applying for FP but i want to ask how to reply for a question regarding eea national current employment, as currently she is unemployed, so would i say that she is job seeker or self employed???

Well is she self-employed? If not you should certainly not say that.

If she is a job seeker, that is clearly what you should say. But how long has she been in the UK, and has she previously been working in the UK? If so, for how long?

Is she exercising treaty rights as a jobseeker?

To be considered exercising treaty rights when unemployed, a person should be involuntarily unemployed ( i.e did not resign from a job or not wanting a job) and registered as a jobseeker at JobcentrePlus ( often pejoratively referred to as "The Gestapo" by the unemployed).

They must also have a genuine chance of securing employment and may have to supply proof of jobs applied for etc.

If unemployed more than six months then it becomes very difficult to be accepted as a jobseeker who is likely to be employed under the EU Directive 2004 rules.


If an EEA national is claiming means-tested benefits or public funds, UKBA often claim a person is not exercising treaty rights and is an unreasonable burden. Thus, in those circumstances the EEA national would be unwise to contact UKBA to detail their circumstances, as it will surely be used against them.

sorru guyz the question is me and my wife are both living outside uk and want family permit to travel together...now according to law if we reside in uk less than 3 months we need not to show any job in uk until we reside there for period longer than 3 months... now in fp application they ask for eea natoonal current job...she has completed her mphil but didn't get any job not here or in uk at this time...so the question about eea national job could how be answered?

Absolutely right.

As regards saying about "current job", just say something like "Not currently employed". UKBA cannot reject the application simply because she does not currently have a job.

but is it not wise to say jobseeker in the end she is here job seeker + will be a job seeker in uk after landing there.... but i think so if she is job seeker she need to show some application regarding job seeking or according to law they cant ask for this application

and marking not currently employed can have negative impact on application?

The problem is that the application form is trying to cover a number of different situations and therefore asking for all sorts of information, much of which is not relevant in a particular applicant's circumstance.

For example, say the two of you just wanted a two-week holiday break in the UK. What would you apply for? Yes an EEA Family Permit!

Another situation .... EEA Citizen is already in the UK, and has been for quite a while, it is relevant to the application, because it needs to be shown how the EEA Citizen is exercising Treaty Rights in the UK.

But as regards your application and "Job Seeker", I have no strong feelings, and that is the case because it is irrelevant to the success of your application.

so i should apply for eea family permit to accompany my wife and we will be going to just visit uk for my vacation
