Residence Card Holder - working Abroad in non - eu Conutry

Hi All,

I've got a question to ask,, I'm a non - eu National residing with my eu wife & son in the UK & my wife is excerising her treaty rights, I was issued with a 5 year residence card early January. Now I've been offered a job in one of the gulf states(non - eu) country and I'll be going there for 3-4 months and then coming back to the UK for a visit for a week or so? and then going back again to work. I was just wondering would UKBA curtail my residence card as being absent from the UK for a longer time? My wife & son will stay here in the UK and my wife would continue to excerise her treaty rights...

Please advise.

That is fine but you will not be able to apply for permanent residence until such a time as make five years in the UK without breaking your residence (which may not be an important issue for you personally). If you stay outside the UK for six months out of any given year, you will break your residence. Aside from this, if you are ordinarily resident in the UK for more than 90 days per year over a period of years, you will may be liable for UK tax. That is something you should investigate with the help of an accountant.
