EEA4 after EEA2

Hi All,
Thanks all for this great forum and very knowledgeable inputs from members. I wish I had come across this forum before.
I have some questions regarding EEA4 applications and UK Nationality.

-- i have received my 1st EEA2 in October 2007 - then I applied for rights of retention last year and received in October 2011 - next week I will apply for my EEA4 as I have completed my 5 years without restrictions on 31st October.

If I apply for EEA4 now and lets say the EEA4 comes in March 2013, would I have to wait to apply for nationality till March 2014 or could I be eligible to apply for UK Nationality already on October 31st 2013, as its exactly 5 years + 1 year without restrictions.

- would I need to present my EEA family members original passport for my EEA4 application?

- Also I travel abroad occasionally for work - and I assume a notarised/ certified by a lawyer copy of my passport will do for initial stages until they request the original one back?

What did you submit for your retention. did u have to include your ex-spouse I.D ? And also that they were exercising treaty right at the time of divorce ?

No as you have retained your rights.

It works the other way round. You need to submit the original passport for the initial checks. You can ask for the passport back at any stage and it will not affect the application. They might ask for it in a later stage or issue the vignette on a stand alone piece of paper.

To answer your question Austin - I submitted basically " my life" in a package weighing over 1kilo.

But mainly, My work proof since seperation, my ex's proof of excercising Treaty rights (via study and work) over 3 years till the date of divorce(decree absolute),all our relationship proof of living together contracts over 3 years in the UK, marriage certificate, photographs over 4 years, joint bank accounts, utilities & council statements, holidays taken together.. you get the idea.

I also wrote my own covering letter - covering The Immigration (EuropeanEconomic Area) Regulations 2006 and attaching all the proofs in a systematic manner.

Yes. I also submitted her EU passport as well.
