Just wanted to share that I got my zambrano residence card today. So happy. After such a long time of waiting I finally have my life back.

My timeline is:

First Applied 23/01/2012
Refused with no right of appeal 23/02/2012
Appeal Anyway 27/06/2012
Judge Allowed the Appeal 24/08/2012
Derivative Residence Card 25/01/2013

PS residence card issued after a pre-action letter for judicial review because of the length of time taken to issued status paper.

please what is the remarks on the residence card.is it a derivative residence card or the normal residence card.
for the sake of the members who have applied under zambrano,could u share a bit of your case with us if you dont mind.what is your storyline

It's says derivative residence card.

With regards to my case: I have a special needs child and although his father plays a part in his life ( we live together) I was recognized as his primary caregiver, because I'm the one who does basically everything for him, including hospital appointments, caring for him during the night and liaison with the council to ensure he had his statement of special educational needs. My solicitor also sent in an independent social worker to asses our family.

A deritative RC can be for any length of time (1 - 5 years)

if the child is 17 when you apply then they can issue a 1 year card (to take you to their 18th birthday when they legally become an adult...)

The aim is to get onto another immigration status before this point though... the DRF is just a means to an end...

DRF cannot lead to PR. (except 10 yr route).

Once youve got your DRF you aim for some other form of residence (IE: FLR(M) - human rights ETC - which will enable you to get PR / ILR... as just because DRF was granted this time, no guarentees it will be next time.... circumstances change. and just because a mother needs to be the Primary Carer for a young baby ... once the child is 5/6/7... the case may not be the same... so they COULD refuse it... (which JR would resolve that all the same?)

We thank God that UKBA has now finally started working. Hopefully, the rest of us will be hearing from them soon.

HI Nat1979, does your derivative residence card has 'no recourse to public funds' written in it? They said it will have something like ' employment and business activities allowed' written in it. Is that right?

It does say "employment and business activities allowed". My solicitor confirm that I'm allowed to claim public funds.

This is good news for those waiting for their zambrano residence card.. It will keep them motivated. Pls can u tell us if u were asked to go for biometric or does it not apply to EU residence cards because i thought ukba changed d rules in dec 2012 that all application will have to do biometric.

It came by recorded delivery to my solicitor's office. Also they sent back all my original documents.

Sorry I missed the earlier question. I didn't do any biometrics. But that could be because UKBA already holds my biometrics for a visa I had before.
