Home office sent supporting documents to the wrong person

I was hoping someone might have some suggestions as to what to do...

I'm an EU citizen (from Scandinavia) and my husband is not. We've been living, studying and working in the UK now for 6 years and sent in our applications for permanent residence in July last year. Unfortunately, our application was returned the first time around, as we had only included supporting documents for me (silly, I know..). We then sent the applications again and it was received by the Home Office in September I think.

I had to travel to my home country with our baby and requested my passport back. I specifically indicated on the document request form that only I needed to travel and therefore only my passport was required. Nevertheless, they returned both our passports. They did not return our documents and i assumed this was because they were still processing our application.

Today, we had received a letter from an unknown man, informing us that he had been sent all our supporting documents by the Home Office! He tells us he returned them to the Home Office informing them he had received them in error. However, before he posted them, he took pictures if them to show us he had in fact seen them.

What should we do? I think this is a major breach of data protection...

yes, it is a breach of data protection and confidentiality. i think you should complaint and if you want to take it above, collect all evidences you can from the unknown man and sue HO plus inform the press.

Thanks for your reply. Hm, easier said than done, we've never sued anyone let alone the Home Office :? I guess we'll have to figure out how to get a lawyer that won't charge too much. Frankly, I'm so upset right now it's beyond belief..

i can understand you are very upset at the moment but don't let HO get away easily with this kind of serious mistake.

Ive got a complaint ongoing with the ICO regarding my employer...

they are very helpful...

email them, and send a copy of everything you know... (unknown mans name / address ETC)

also, complain to UKBA via email/ postal letter ETC and state you would expect an adequate meeasures to be taken ETC ETC...
