Calculating the five years EEA2

Hi everyone,
I applied for EEA2 in April 2008, but after so much,it was granted in sept 2010. Because the delay is not my fault . Can I count the five years from the the day I applied in 2008. Any advice will be really appreciated. I will respond to any question if more clarification is needed. Thanks

It would be five years from the day you began to live in the UK as the dependant of an EU national. You have not said anything about your history so I can't tell you when that period started.

You need to tell what date you married or started relation/dependency with EEA national?What is EEA national's nationality?What EEA national has been doing( studying/working/self employed/self sufficient etc)? Is there any absence of 6+ months outside the UK in 5 years? Had any benefit claimed?
Someone will certainly give you the right advice shortly.

According to
this, you have obtained your RC as extended family member. As such your time started when the RC was issued. However it should have been issued (or refused) within 6 months of your application so you could argue this should have started around October 2008. It will mostly require going through an appeal to achieve this.

Thanks so much. In 2008 obviously we were advised that we could make such an application. 2008 march,submitted an application, a letter like COA was issued. Used the letter for NI and drivers Licence. Because the application was for two family member,the file was separated and that compounded our problem.we could not split the EU (sponsor document) into two. In sept 2008,the HO requested some document. We submit all doc together but was divided the doc and we were treated separately. HO kept requesting for doc in the other applicant and verse versal. That took a long time to resolve and in 2010 oct we were eventually refused. We appealed, and went to court in 2011 march and won. RC was issued in sept 2011. It's An extended family member. Thanks. My sponsor is French and has been working since she arrived in the uk.help
