having got the family here under Sing/Eind rules at port {im a Brit that exersized a treaty right) Im filling in WTC forms and want to here opinions regarding the wifes status where it asks if she is "subject to immigration control" My thoughts are that she is not since her right derives from me?

I would say no as being under the EEA regulations is not subject to immigration control. See also the defintion on HMRC website - Immigration control. In any case, her status wont matter as you will be entitled to WTC because you are British.
