Eea family permit questions

Hi im mexican, my husband is from Romanian (eea citizen). At the moment we live in Romania, we got married 8 months ago and i got a residence permit for 2 years in Romania ( as a family member)We we would like to move to London, the problem is i got caught last year in london by immigration because i overstayed, but i left voluntarily and paying for my own ticket. I wonder if we can move back to London without applying for the eea family permit? Cos like a mexican person normally we dont need a tourist visa and we can stay 6 months in uk. I hope you can help me.

I had a look to the questions and Im a non visa national, my question is that i got caught 1 year ago by uk immigration cos i overstayed, i left voluntarily and paying my own ticket back to Mexico and they didn't give me any interdiction, but i've been told that i can not go back to Uk during 1 year, even if this year past , can i still have any problems going back?

Your previous overstaying should not affect an application under EEA rules.

Thanks a lot but your answer but It doesnt affect even if im going back WITHOUT the EEA family permit????

Thanks a lot, but I want to know if im going without applying for the eea family permit with my husband wich is a (eea citizen)and with the marriage certificate can I have problems at the border?
Like a Mexican I don't need a visa to get inside London.
