The children were born in uk. Does that not make them nationals of uk and therefore EEA nationals?

Birth in the UK does not automatically make a baby a British citizen. The baby needs to have a parent with British citizenship or settled status in the UK in order to be born British. or they have to wait 10 years
wait for your Appeal if successful then child can register as a BC
