Surinder Singh method

Hi all

I thank you for your time in advance.

I'm not married yet. I want to bring me wife-to-be from Pakistan.

Teaching English in Slovakia is in demand and I can get a job there for a few months. I'm thinking of using the Surinder Singh route. Can I get this right please?

1. Tell HMRC I'm going to work abroad.
2. Go to Slovakia for 3 months. Do I need to show ferry ticket from Dover?
3. Job is ready for me. Work there for 3 months.
4. Return to UK.
5. Go to Pakistan and get married.
6. Have solicitor do the paperwork.
7. Wife gets visa and comes to UK

What proof etc do I need.

Is it as simple as this?

If Surinder Singh route was not diluted, even then you were not able to do that because:
3. Job is ready for me. Work there for 3 months.
4. Return to UK.
5. Go to Pakistan and get married.

This route stated that your family member HAS to be with you when exercising treaty rights.
But you are planning to work there, then return and get married will not make you a qualifying sponsor.

You may be able to bring her to Slovenia shortly before you return to UK, and that will be fine. However you may have the " centre of your life issue" to deal with though.

Here's the difficult part in the new Rules highlighted:
According to regulation 9(3), the centre of a person’s life will be assessed by reference to:

“(a) the period of residence in the EEA State as a worker or self-employed person;

(b) the location of [the person]’s principal residence;

(c) the degree of integration of [the person] in the EEA State.”

In about 10 hrs time, many Surinder Singh people will be screwed, except of course UK court gets it acts together and strike down regulation 9 (3) , or apply it in accordance with union law, and not conservative view of EU law.

I will be returning via the surrinder route. I know the rules are changing but if people are prepared to move to another country for the sake of the SS route, then surely staying long enough (longer than 6 months?) and genuinely making an effort to make it the centre of their life shouldn't really be that difficult.
If the legal loophole is a way out for some, I'd say even with the new rules, its still fairly easy, cheaper and worth doing if in the long run its easier than the spouse visa.
