Renew EEA Family Member 5 Years Permit Question

hi there,

There was a question like this from 2010 but I thought I'd check if there's something new...

my wife has a UK Permanent Residency of EEA National (myself, Italian), which expires in Sept 2016.

We have been abroad for more than 6 months at some point so according to https://www.gov.uk/apply-for-a-uk-resid ... dence-card we cannot apply for Permanent Residency card.

Getting another 5 years permit would be just fine, so can we just get another 5 years permit like the one she has now? That would be perfect. EEA2 form should be the one, right?

You can apply for 5 years RC using EEA2 as many times as you wish (assuming you meet the requirements) so that's not an issue.
Depending on the reason for the absences and timing, she might still qualify for PR.

thanks so much, that sounds great... as for PR I will check that out too. I think it took 3 months last time we applied the residency permit (can't remember) does it sound right? so say we apply 6 months before expiry that should do :D

Why have you been abroad? Was it for study or different reason? How long have you been abroad?

well it was 6 months and 15 days exact, due to my job in another EU country then now moved back to UK.

Were you sent by your employer to a different EU country?

Overseas posting allows 12 months of absence without affecting residency. See Regulation 3 (2)(c).
