CSI in case of ROR when EU partner is eligible for PR

hi everyone,
My question is if non eu national applying for ROR and his ex eu spouse is already eligible for her PR coz she exercised her treaty rights for 5 years and her current status is full time student. So the ex eu partner and non eu person both still need to have CSI????

please help.

If your ex is already PR, no CSI will be required for ROR. That said, if ur ex has not got a PR card, the Home Office are going to want to see proof that she is PR.

and what non eu person will he need CSI at the time of when he ll apply for ROR???

No, a non-EU spouse does not require CSI if his EEA spouse is PR. However, after the divorce, to be legally resident the non-EU spouse will need CSI if he decides not to work and becomes self-sufficient or a student. But even if your ex were not PR, as a student she only needs to get CSI for herself and not for her non-EU family member.
