Hi,

I'm an EEA student, applying for permanent residency.

With regards to the documents required for Section 8 I was wondering whether there is an official declaration to be used by students?

On the form it says the following on page 112:

(Student only) A declaration, signed and dated by the relevant EEA national,
confirming that they have/had sufficient financial resources to cover them and any
family members living in the UK (if applicable) not to become a burden on the UK’s
social assistance system during their period of stay in the UK as a student.
This should be witnessed and counter-signed by a Commissioner for Oaths, public
notary, or magistrate.

Is there an example available or do we write it ourselves? Also I understand that this is instead of providing bank statements, is this correct? One last questio: will I need to submit all sections that I don't have to complete as they are not applicable?

Write it yourself. A few people get an affidavit but that's unnecessary. You do not have to prove resources with bank statements or grant letters, and if a caseworker disputes that, print out page 40 of this government guidance to show them.

My EU partner was in the same position. He sent his EEA PR application on 4th April (after months of document sorting!). Part of his 5 years treaty rights he spent 3 years as a student. Having read that wording, we assumed that a legal document was necessary to prove financial self-sufficiency. He walked into a lawyer's office nearby who drafted the letter and stamped it for a £10 fee. Like rosebead says, according to the regulations it isn't necessary but we figured it would be safer than having to send more documentation later. We also sent a grant letter for his scholarship for the period he was funded. Hope this helps. Will keep posted about the outcome. We've only received a confirmation letter so hoping all is OK so far.

Looking at the EEA(PR) form, it seems the Home Office does require a sworn declaration:

(Student only) A declaration, signed and dated by the relevant EEA national, confirming that they have/had sufficient financial resources to cover them and any family members living in the UK (if applicable) not to become a burden on the UK’s social assistance system during their period of stay in the UK as a student.

This should be witnessed and counter-signed by a Commissioner for Oaths, public notary, or magistrate.

The Free Movement Directive doesn't appear to have such a requirement though, as it allows students to make a declaration by any means they choose, but if it costs only £10 to get a sworn declaration you might as well do it to not delay your application.

Hey there! I am about to apply for the EEA PR soon and I was wondering whether the declaration was sufficient enough, as I am unsure what documents to include for this section and all reviews seem to be guiding in different directions. Thank you, it is much appreciated!
