hello every one
just a short question. Im a husband of Eu citizen arrived to the UK 10/02/2011 got my RC on June same year
do i need to wait till July 2016 to apply or i can apply for the PR next February.
my wife (she got her PR already)was off from work about 18 months including her maternity leave ..would that affect the application?thanks

You can apply for confirmation of PR as a dependent family member after 5 years of residency in UK assuming:
you were married to same person all that time;
&
that sponsor was in UK exercising treaty rights continuously for 5 years (or has acquired PR);
also
assuming any absences from UK (for both you & spouse/sponsor) were within prescribed limits

Based on your stated timeline that application could be made as early as coming February.

Note Maternity leave does not interrupt a sponsor's qualified status as a worker.

If you have answered yes to question 9.3, you do not have to complete the rest of this section –
go straight to section 16 instead. However, we reserve the right to ask you for more information
if necessary.

If the relevant EEA national is or was an accession state national who worked for an employer
during the accession period (see subsection B for definitions), you should also complete

the sponsor named in section 2 and you strictly require their personal care on serious health

So what is your reply to Q9.3: "Yes" or "No"

If you replied "No":
Subsection B only applies to accession nationals (A2 or A8) - so what nationality is your sponsor?

And even if it is "No" (to Q9.3), the following sections are very unlikely to apply to you:
Section 12, 13, 14, 15

i answered yes to 9:3 but my wife is polish and shes been on WRS bfr getting her PR on 2011.

So (assuming you have the PR card & will enclose it with the application) you simply jump to Section 16 after filling in Section 11 as you are spouse of your sponsor.

Skip all the other stuff in between.

Note you don't need to print out & send in sections that you do not have to complete.

thats what i read ..i hope its my last question

Subsection A: evidence of the relevant EEA national’s activity as a qualified
person
 Your sponsor’s document certifying permanent residence if you answered ‘yes’ to question 9.3,
or
 Proof that you have/your sponsor has been a qualified person for the relevant period – see
below.
Employment
 Letter from each employer confirming the dates you/your sponsor worked for them,
salary/wages, normal hours of work, and the reason the employment ended (if relevant)
 Wage slips and/or bank statements showing receipt of wages (this must cover each job you
have/your sponsor has held during the relevant qualifying period)
 P60s for each year in which you were/your sponsor was employed.
If you can’t submit the documents above (for example, you’ve lost the relevant documents, the
employer is no longer trading or you are/your sponsor is unable to contact them), you should
enclose a letter explaining why not and you must submit alternative evidence of the relevant
employment, such as:
 P45s
 signed contract of employment
 notice of redundancy
 letter accepting resignation
 letter of dismissal
 employment tribunal judgment relating to the employment.

Does your sponsor (spouse) have a PR card or document?

I understood 'yes' as you previously posted you answered "Yes" to Q9.3
If Yes is correct then submit the card.

If sponsor does not hold a PR card then there is a lot more documentary evidence to be submitted; (you just posted the list above).

Note your wife will also have to complete Subsection B of the form (as she is an accession state national) if she does not have a PR card.

yes my wife hold PR since 2011
so does she need to fill section b? i think no .
its just this application alot of confusions .

Do you mean she has a PR card (issued in 2011) or she acquired PR automatically in 2011 but has not got a PR document?

yes her PR were issued on 2011.

So submit the PR card.
(No need to complete Subsection B).

Suggest keep copies &/or scans of all documents & form you send to HO - for your records & future reference.


HO will write and ask if they have any questions about your application.

my wife is travelling in march with her ID
i want submit her passport but its still without the maiden name however the PR is with the maiden name is that will cause a problem with HO??please any advice?
