Hello all !

As I got a refusal for EEA(FM) and my passport been retained with HO. Now,I'm going to re apply in a short while. I called at HO Helpline to ask for my passport situation. They said to complete a form to ask for your passport back. In the form there is question that Do I need to with draw my application ? I am not sure if I have to say 'yes' or 'No' Because I am going to refer my previous application refusal and new application will be linked to old application anyhow.

Please guide If anyone of you has completed that application before to ask your documents back .Below is the link of form:

If you have got a refusal, you do not have any outstanding application with the Home Office anyway. So, it is immaterial whether you choose yes or no.

Your applications will be linked by the Home Office Reference Number that you got in the refusal letter, if you enter it in your next Home office application.

My question is : Do I need my passport back from Home office for the new application or just write an letter stating that my passport is with with them for my new application ?

Because the lady suggested me that I have to request my passport back and send it to them with new application .

You can just submit your new application and specify in the cover letter and application form that they already have your passport !

I dont think they will return it to you unless you have a valid visa on it !
