EEA Family Permit:Chilean Civil Union recognised in UK?

Hi,

I would be extremely grateful if someone could help me with the following query :)

I am an Irish national who will be moving to the UK and, hopefully, my Chilean partner will be able to come with me. We have been together for four years, and will have been living toegther for two years by the time of the application. Unfortunately, it is proving rather difficult to document that we have been living together for two years.

So, we are considering getting a Chilean Civil Union. Would this be recognised as a civil partnership in the UK and by European law (we are a hetrosexual couple)?

Wouldn't a PACS be easier?

Also, to the best of my knowledge (I could be wrong), a PACS or civil union will not be treated as the equivalent of a marriage. Your civil partner will be treated as a durable partner and so, s/he will be an extended family member with no right to work till s/he gets her Residence Card.

Noajthan, I am not sure that the link you provided would be relevant as that article specifically relates to same sex couples, while the OP has stated that they are a heterosexual couple.

Yep, saw that Simon. I posted the link to flush out that very question.

It may be an indication non-same sex CUs don't fly in UK. Not sure.

Then, as you have mentioned, the non-EEA partner would be considered to be on the extended family member trajectory.

Thank you for your replies.

As far as I'm aware the PACS is essentially the same as civil union. Is the PACS recognised in the UK for hetrosexual couples?

Also, this may be a completely irrelevant question, but would decisions on EEA family permits be made based on UK immigration law or EU law?
