Help me please!! EEA Perminent Residence Application

Okay so I am 25 year old former student who graduated a year ago. I have lived in the UK with my mom and other siblings since the age of 10 after moving from an EEA country. I tried to apply for a permanent residence last summer but it was refused on the ground that I needed comprehensive sickness insurance as the time I covered I was a student which was from 2011-15 at University.

I was also working part time whilst at University (2011-15) and also getting student finance support. I was entitled to student money because of my working status as well as my moms at the time. They originally deemed me as an International student but the changed their mind after showing them mine and my moms work evidence. My mom has had a Permanent Residence Card for years, since 2010 I think. I originally was going to apply with her but my student time got in the way.

Because I have effectively been working on and off at different places since 2011-2016 I have a 5 year working history but its not contionous i.e. 5 years of full time work. From 2011 to 2015 I was working part time, 2015-16 I was on and off different jobs and JSA benefits and its not only until the April 2016 I found a full time job. Would this be classed as continuous 5 year work? Also would I not have a special case if my Mom and other siblings also have the Permanent Residence card. I am filling in another application now and I don't know if I can use her as a sponsor. Much glad if you could help, thanks.

What was your mother doing in the UK, when you resided with her as a child of 10?

Was she in gainful employment, self-employment?

No special cases; however, you must have acquired PR automatically as a minor if you have been in UK for 15 years and mom has already acquired PR.

If your work history has gaps and you didn't have CSI/EHIC (or alternative) to cover your carefree student years then suggest the following:
choose a 5 year period when you were aged under 21;
and
mom was exercising treaty rights continuously (or else already had PR);
collate your evidence including identity, relationship to mom and residency in UK during same period and apply again.

Good luck.

Okay so would she have needed to have a PR for a continuous of 5 years. My mom got her PR around when I was 20/21 so I'm not sure if that is feasible. Also what do you mean by "exercising treaty rights continuously". So would I need to apply as she is sponsoring my application. What areas of the application would I need to adjust if she is the person sponsoring me, thanks

Mom could have been exercising treaty rights for 5 years instead of holding PR status for full 5 years.
That would work too. And you could have been under 21 on that basis.
Does that float your boat?

It means working and/or being selfemployed (and/or being a student) for 5 years (with no gaps nor prolonged absences from UK).

Apply (on PR form) as main applicant and with mom as sponsor (section 2).
