On Appeal and getting married

Hello, My case as a EEA Partner refused. Stupid reason is You don't have valid passport and i m on appeal now its about 2 months now. I been marriage regestrion office give notice for wedding she phoned to HO and now she waiting for response from HO because we can't get married until HO not allow us. So plz my Question is we are living together from nearly 2 years we a son together my appeal is pending so what HO can do now about our marriage they still can stop or more chances they will let us married?

The registrar was legally bound to notify the Home Office. They are very likely to extend the marriage notification period from 28 to 70 days in order to interview you both separately before the wedding can take place. Your appeal may save you from being detained on the day of the interview. In any event, I don't believe you can marry without a valid passport. How short of 2 years living together are you?
Has your passport expired?

Proof of identity is a fundamental and well-publicised requirement in applying for EU-related documentation.
How else is HO supposed to know WHO you really are.
Do you have any other form of proof of identity?

Provided an appliant or an appellant can show that
Regulation 29A is engaged, they are entitled to succeed in their appeal or application , as the case may be, and the burden will be on the SSHD to justify refusal to exercise the discretion.

When i applied for RC as an EEA partner. My passport was expired and i did send then my old expire passport and when they refused my case on the bases of invalid passport then i been to my embassy to renew my PR and they did renew so then i been council office for marriage registration.
We are living together with 1,8 months with all prove like council tax, Electric bill, house lease, etc etc even my son is now 10 months

I doubt that you went to your embassy to renew your PR, but assuming that you mean they renewed your passport, why didn't you send this to the Home Office if they refused due to an expired passport?

That s main thing i m scared to be detained. Lol

My relationship is 100% true relation i m not worry at all about that biggest prove is we have a son together. In any of these cases you seen the still can detain?
As i told i m on appeal its 2 months now. Tribunal deduct fee from my account just after a month so any idea how long the will take to get hearing date letter?
