EEA FM (parents) application for Residence card

Hi

Would sincerely appreciate help and info on the following.
Am a non EEA national married to EU national holding PR. My spouse and I both work, me having RC.

Now I would like to have my parents stay with us as they are old but they are non-EEA nationals.

They have visited UK last year on visit visa sponsored by my brother (British Citizen) and have currently applied for another visit visa from their parent country and awaiting decision.

My queries are:
1) Once they here on visit visa sponsored by my brother for 6 months, can they apply for residence card basis my husband's EEA status since he has PR in UK. I believe my parents would fall under Direct family members of EU national.

- I do not have dependency proof of continuous money transfers though I transferred bulk amount upto 3 years back and they receive handsome interest basis those funds. This is in parent country (non EEA)

- Once they in UK, though my brother has sponsored their 6 months visit actually willing to sponsor only 3 months, can I show that they would be residing we me and my husband for the RC application? what documentation would be required? and how soon or later once they land in UK on visit visa can we apply for Residence card?

2) What if visit visa expires before the COA or the RC is received? Can they still continue to be in UK or would it be violating visit visa?

3) If this application for RC is done under EEAFM route, would their future visit visa sponsored by my brother be affected towards negative?

1) You need proof of current dependency for essential daily needs. Not a one-off payment 3 years back.

HO plays hard ball, scrutinises such applications with a fine tooth comb and frequently refuses them (even stronger cases than yours). Expect a battle on your hands.

2) If visit visa expires they will be overstayers if any RC application is ultimately refused.

3) If you get this wrong (& RC application fails) parents are unlikely to be granted a visit visa to UK ever ever again.
