EEA PR Refused on Low income Self employment

Hi
Me and my wife got refusal on our EEA PR application on the basis on low income while self employed. I have read many posts and am aware of HO MET test and EU directive.
My questions is about the success chances of appealing refusals on such grounds?
I as a non EEA family member have been asked to leave the UK in refusal letter. Is this lawful?
Can I apply for another EEA residence card while the appeal is in process? (as the appeal process takes long time till the outcome)

Any helpful comments/ experiences will be highly appreciated! thank you

Yes its lawful.
Be aware appeals can take a long time.

if sponsor/spouse becomes a qualified person it is likely you will not be removed.
