Hi. I am a non eea national and I am due for my PR next year march. My question is immediately I am due in march and I apply for my PR can my husband also apply for his spousal visa from nigeria. Or do I have to wait till I receive my PR (which might be 6 months later due to the home office timescales ) before he can go ahead with the spousal visa application. The reason we would like to do it immediately is we are having a baby in April and I would love for him to be here already by then.

You need to submit proof of your PR status for his visa.
Still need to deal with the 10 year deception/fraudulent documents ban imposed on hubby. Any application he makes will be scrutinised. Do you earn a minimum of £18,600pa to sponsor a spouse visa?

Yes I earn 18600pa. So we wud need to wait till I get the PR? Wow. My baby would be 7months by then...

Yes we are working on the ban too. My fear is that I wil be going on maternity leave from March and won't be able to show that I hv been working fr that period

By "getting the PR" you seem to mean a document confirming PR status.
That is not the same as PR status, which you believe will be acquired early next year.
The key question you need to explore is: does visa application require sight of what is merely a confirmatory document?
Or does it simply require evidence of settled/PR status? Which you may have by early next year.
And EU are not Philistines, worker status may be retained whilst on maternity leave. Adequate supporting evidence required as usual.

yes, thanks for the reply
i am not sure if just mere calculations (that i am now qualified for pr) would be enough for his application OR whether i would have to wait for the actual DCPR which i have now applied for but will need to wait for 6 months timescales.
we really want to try if we dont need to wait for the dcpr as our baby is getting older and still has not met daddy yet.
wat is your opinion pls?
