HO visit after PR application

My situation.
Non EEA national applied for PR in Nov/2016.
EEA national has acquired PR just before I submitted my application. He is now living temporarily in Dubai as he found work there and I am here waiting for my PR.
I have seen post from people in the same situation as mine that have had HO visitors perhaps to check the marriage status and verify shame marriages and all that.

Is this a thing? If so, what can I say to explain the abscence of my partner in the UK now?

Are you expecting HO visit? However you need to be honest with them.

I'm not expecting. I haven't been told I would have a visit and I wonder if they are surprise visits.
If I tell them the truth, will I be in trouble? Would the truth jeopardise my PR application?

Relax mate, they got tons of pre-Brexit applications on their desk to deal with.

well they wont let you know they are coming, most of the visits are around 6am in the morning .
surprise visit . specially when u applying for pr

Thanks for that. Now I am even more nervous. How do I explain that since my partner acquired PR, he moved to Dubai and will be there till the end of the year?

Would you not be in more trouble if you lied?

Do you have evidence documenting your husbands job offer in dubai as temporary? Returning flight tickets? Proof of him visiting home (tickets, bookings)? Letters sent to each other/emails? Call logs? Just to settle your own nerves, that's what I'd do!

Best advice. . Ask a lawyer. Good luck and hope you get to relax shortly.

Thanks for the advice. I appreciate what you are saying.
I could get the flight reservations on my emails and I can give them my partner' work contact so they can call him. That would be enough? Have they got a way to verify my partners in and out of the UK once he is EEA national?

Most importantly, if they do come for a visit and I can't convince them of my situation, what is the worst that can happen to me?

Please, I know it sounds desperate but this uncertainty is killing me.

Are you an unmarried partner of an EU national?

It would probably have been sensible for your partner to wait till you got PR before leaving the UK.

I really don't know the implications, it was just thoughts of what I would be gathering whilst waiting to seek legal advice. I think the only way to stop you feeling on edge is to speak to a specialist with the answers. Best wishes.

There will be no problem if your spouse is away temporarily as you have said and secondly because he/she has got PR is allowed to be outside the country for at least not more than 2 years otherwise the PR right will be lost and you will be back to the starting point again as family member.

However, this is the tricky part now. The HO may delay your application 2yrs from the date your partner acquired/possessed the PR if they suspect foul play and write back to you that you are refused with your application as your spouse have to right of permanent resident in UK and your race back afresh.

You can try ask him/her to write to them with your details with application reference number or come back home until you're sorted out.

I RECON IT'S A RANDOM VISIT BECAUSE OF YOUR RELATIONSHIP, PROVIDED YOU HAVE NOTHING TO HIDE AND GENUINE. OTHERWISE JUST RELAX AND WAIT FOR MAXIMUM 3 WEEKS. I WILL NOT GO TO ANY LAWYER YET IF YOU DO YOUR DESPERATION WILL MAKE ONE RICH.

Again it all depend what time you told them he/she travelled and they might check in the system with flight record etc then the 2yrs away will apply to your case if that make sense.

Well, there are no visits arranged as yet. I was just thinking about surprise visits.
Correct then if I'm wrong.
My partner was a QP for 5 years, acquired PR which means that he does not need to work anymore to guarantee my status so long the civil partnership is not dissolved. Hence why I should be fine as my application was sent after he obtained PR.
Therefore, if HO decides to visit me and think that my relationship with him isn't "normal" (I don't know what they would say here) they can decide to postopone this decision just to be spiteful? Disregarding all EU laws for EEA family members?

If you have nothing to hide then relax.

You can easily prove your relationship with him being out of the country. i.e text messages, call logs, emails, pictures, plans to go and visit, flight tickets etc.
