RC expired must I renew?

There has been no movement on our EEA2(PR) and now our RC has expired. Are we legally required to renew it immediately, and if so what is the procedure bearing in mind all our original documents are currently with HO for the EEA2(PR) application.

No legal requirement to renew RC. But, given that you are on the SS route, your non-EEA spouse may have issues with demonstrating that s/he is legally resident in the UK and thus may have issues with being able to work, etc and also with re-entering the UK if she plans to travel.

Thanks. Do you think there will be any issues re-entering the UK with the BC spouse ?

Yes. A non-EEA spouse of a British citizen is expected to have an FLR(M). As your wife is in the UK under the EEA Regulations/SS route, she will need proof of that.

She may also have issues with boarding the flight without any documentation that she will be allowed into the UK.

Well, she will have surely as the expired RC card will have all the details of her status, and the date on the card will clearly show she had attained the automatic 5-year residency.

On what grounds then would they refuse to admit her?
