An Indian National with Permanent Resident Card as a family member of a Union Citizen

Hi All,

one of my friend came to the UK from India on a family permit as a Direct Family member (daughter) of a Portuguese national (her father). Then got resident card and now have Permanent Residence Card as a family member of a Union Citizen (but still Indian national and got Indian passport).

She now wish to bring her husband from India, so which route she needs to follow. Should she apply for family permit as a spouse application under EEA regulations which is free of charge or she needs to apply for a spouse visa under immigration rules for which they have to pay Immigration Health Surcharge (IHS) and the application fee of about £1400.00.

Any information in this regard and prompt reply would be highly appreciated.

A non-EEA citizen with PR under EU law can only sponsor under the UK Immigration Rules.

On the other hand, the Portuguese national father can sponsor his son-in-law as an extended family member if he can prove that his son-in-law is dependent on him or was a member of his household in the country of origin.

Can your friend acquire Portuguese nationality through her father?
