Non EEA family member divorcing

Hello,
My husband and I have been married since 2003 and we have 4 children together. The children and I have Italian passports. He has a Venezuelan passport.
We have been in the UK since July 2011. I worked for 4 1/2 years as I was ill and could not work for a few months. My husband went to work as soon I was told to cease work. We are divorcing at the minute but I don't want this to affect him being able to apply for permanent residence.
He had a residence card which already expired and applied for a new one (which we he has received), as he wasn't sure he would qualify for the PR as I have not worked fir a continuos 5 years. I do not have the PR.
Can he apply after we are divorced?
