retain right under eea divorce

is there anyone to advise on this issue
application for retain of right was refused
appeal was made aerlier this year.
appeal date was in december,
home office was asked to send bundle to the court and appellantin september 9th but they did not send till now.
has anyone had similar issue and should be done?
