EEA2 PLUS APPEAL

I have been with my wife since 2012, went for a wedding and got arrested on the basis home office believed my relationship with my wife is not genuine. Released in detention and with the help of my MP, Home Office granted me leave outside the immigration rules on 10 years route which i didn't applied for. In January this year, my solicitor said I am likely to be granted leave to remain on extension of 10 years but unfortunately Home Office refused me with the right of appeal.
I have sent a new application for EEA family member on the 28/11 With my wife exercising her treaty right by studying with CSI for her and all my children ans myself both kids are EU nationals born in UK and got a letter from tribunal today for hearing on 01/03/17
Any chances of my EEA2 application decision comes before hearing and any chances of success from both or either of the two

When you applied for appeal and it's paper appeal or oral appeal ?

What leave they give you after releasing you from detention and on what grounds ?

Currently by looking at timeline mostly people getting there result in 4 to 5 months. Some people. Awe decided in 3 n half month.
