EEA Resident card and British passport for a new born baby

Hi All,

hope all is well .

i need your help , my wife is from Poland and leaving in uk since Jan 2012, she is a teacher and working through different agencies as a daily supply teacher. we got married in 2013 and i have a resident permit after marriage.

Our new Born baby was born on 1st October 2017 . My question is; Can we apply for resident card for my wife and British passport for my daughter ?

You child will only acquire British passport only if your wife has secured Permanent Residence Status prior to his or her birth.

It seems likely that your wife has achieved permanent residence. The biggest problem is whether your wife counts a worker during the summer holidays. I don't know enough of practice and legal precedents to give a confident answer.

The preferred sequence is to get your wife's DCPR and then, armed with the Home Office decision as to when she achieved PR, apply for your daughter's British passport. If she has not achieved permanent residence, it is likely that you were working illegally during the school summer holidays.

Hi All,

Thank you i am back because i need your help.

First of all let me give the update about my previous post.

I did apply for my daughter's British passport in December 2017 and they have granted the passport to my daughter in Jan 2018.

Now the new topic is below.

My wife is on maternity leave until September 2018, and the 5 years of our marrige will be completed in August 2018, we are bit confused shall we apply our permanent resident cards together or shall i apply for my wife first and then mine.

There are few points where i am bit concerns .

1- They have granted the British passport to daughter it means that they are satisfy that she has been doing treaty righst for last 5 years ( again i dont know if they home office and passport office work together or similar)
2-
my wife is thinking to not go back to work for at least 3 to 4 months just because of the baby is still very small to be left with someone . and if she stopped her treaty right they may have can refused or resident cards, but if i apply for her permanent resident card now during her maternity leave will she get till September? And also can i have the latest filled form to see how to fill all the relevant questions,

Please can someone reply me on all above .

Permanent Resident card for a family member of an EU National

Respected All ,

Please help me for applying my permanent resident card after 5 years of marriage .

My wife is a polish national and she has obtain her PR on 20 July 2018 within 22 days of timeline.
i am applying my permanent resident card on 28 august 2018 , i have few questions .

My wife was on Maternity leave and her leave expired on 25th July 2018 and she did not go back to work because of my daughter she is just 10 months old ,will this effect on my case and do i have to send all here documents such as P60'S , BANK STATEMENT OR I CAN JUST SEND HER PERMANENT RESIDENT TO SUPPORT MY APPLICATION .

I am sending below documents please see and let me know if i am missing anything .
5 years Tenancy agreement of us showing that we are leaving together .
Marriage certificate .
GP letters confirming the same addresses .
Her permanent resident card .
my daughter's UK birth certificate and her British passport .
Council tax for last 2 years with our joint name
utility bills for last 2 years with our joint name on them .
My p60 's for last 5 years .

Please advise me on above , your time and cooperation will be greatly appreciated .

CCJ PR APPLICATION

HI All,

please please reply ASAP . I am sending my application for a PR as a family member of an eu national .

i am worried and do not know what to do . i had CCJ against me (Credit card payment 1300 £) in 2013 , i had cleared all the payments in 2017 and got the Certificate from the court saying that the judgment is satisfied and paid all the balance. my question is will this effect on my PR application ?

Can please some reply to me ?

It will have no effect.
