EEA permanent residence card

Hi

2 questions;

Firstly ) should I replace my EU biometric permanent residence card for EUSS biometric residence card ? Will Eu/eea biometric permanent residence card be useful after December 2020 ? If not should I exchange before December 2020 ? ( I have settled status under EU settlement scheme too )

Secondly)

I came across this ; Please note that a BRC issued under EEA Regulations provides you with an exemption from the requirement to obtain a visa to travel to another Member State of the European Union.

Does it mean I can travel from UK to Germany or France alone without my spouse ?

Hello,

Yes, you need to exchange your card as it won't be valid beyond Dec 31, 2020. So at the moment, you need to engage the process of getting the card under the EU Settlement Scheme.

Your EEA card allows you to travel visa free in the EU but with your partner, not alone. They won't let you board if you present alone.

Well it will actually be valid until the 30th June 2021.

There is no need to swope a PR for Biometrics, as a person can continue to hold dual rights until June next year.

But I agree that he should work on getting settled status.

According to what the Home Office published, these cards won't be valid beyond Dec 31, 2020.

People without the physical EUSS cards, can still use the electronic right to work for their employers. But that digital check won't allow travelling back to the UK.

Do I need to pay £65 again or I can swap it for free ?

I have permanent residence biometric card
I have settled status (online link)

The withdrawal treaty makes provision for no changes in the status until June 2021.

So I stand by the views i express.

Unfortunately, the UK authorities, like their Irish counterparts do not always comply with a law to its letter and spirit.

One cannot therefore use their inaccurate press release as the benchmark.

But once they publish it on .gov.uk page, many airlines, border force workers... etc are going to follow it.

From Jan 1st, people trying to fly back to the UK with EEA cards issued in the UK, may be denied boarding as per the communication of the Home Office.

That may be wrong from the legal point of view, but when you are denied boarding abroad based on a communication from the Home Office, you don't have a lot of options.

Is there any information on whether UK border officers will be able to access digital Settled status database? If a person is not EU, but is a non-visa national (so there will be no problem boarding the plane), and if digital settled status is connected to the passport?

The British border officers can access anything they want about immigration status including EU Settlement Scheme status. However, if you are abroad, you face an airline company and foreign officials. They can't access your status and the letter or the email you get from the Home Office indicate that they are not proof of status.

Yes, we understand that, but I am talking about non-visa person (US passport).
We never had an issue boarding a plane to UK by just showing US passport (without showing BRC for UK).
Also, EU citizens will not get any card, right? So, if a French person with settled status is abroad, and wants to come to UK, they are in exactly the same situation - they have passport which allows to travel to UK at least as a tourist (so air company should be OK with them, hopefully), but they have no proof that they have settled (or even pre-settled) status to show to airline. And then at the UK board, I hope, board officers would just check digital settled status.
So to me it seems that not having a card under settlement scheme should not be a problem for someone who is NOT a visa-national - in the same way as it should be OK for EU citizen.
No? Am I missing something here?

Yes and no.

Imagine the following scenario: the UK restricts access to the country due to Covid (as many countries did) and only British citizens or residents are allowed in. If you are stuck abroad without a physical proof of your status, they won't let you board.

Other situation: you interview for a job and another candidate is British or has an EU Settlement Scheme card. It's easier for the employer to see and understand the status of the other candidate who would then get an advantage over you as he would seem hassle free.

Or you go to register with a doctor and the receptionist tells you: I don't know what this digital status is, I am not an immigration specialist. I want to see a card in order to register you.

We can imagine situations where the digital right is an issue.

Agree - but again, any scenario you describe can happen to a EU citizen with settled status in the future. And so far HO refuses to issue them any card (there is some activism around it to lobby for physical document - exactly by reasons you mention)

I am a non EEA family member with a PR(sticker) on my passport and I am currently outside the UK. I have not been able to return to the UK due to various reasons apart the various COVID restrictions at one point or the other in 2020 and read online that holders of PR have until June 2021 to apply for Settled Status, so have really dragged my feet and planned to return to UK this December but have cancelled this due to COVID again.
Now planning to come to the UK in February 2021, will I be able to enter with my current PR on my passport so that I can apply for the settled status? I am worried as I have just read another conflicting information on gov.uk that the old PR and permits will cease to be valid after December 2020, ironically the same website says we have until June 2021 to apply for settled status. Please help if you have any information regarding this, many thanks.

PS: Please forgive me if I have posted this in the wrong thread, I could not find where to start a new thread.
