Separate from partner with daughter.

Hi everyone
Please I need some answers for my questions.if anyone can help .
Married with my wife she is from EU country I got EU pre-settlement August 2018 we have a daughter will turn 4 years old next month .
The wife decided that want to live with her mother and to finish our relationship.not divorced yet and I don’t have court order ,since then my daughter spend 2 or 3 days a week with me .im full time worker and I share her expenses as well .
I need to apply for new application this coming August but I don’t know which one .
if there is one can I apply now ?
