Hi,

I am British citizen. My husband is Syrian (non-EEA). We got married in June 2011 and have registered our marriage in London. I moved to Ireland to live with my husband soon after that. I was looking for job in Ireland but could not find. My husband is working in Ireland with good salary. My husband got a permanent job offer in the UK. The company is not going to act as a sponsor and thus will not contact the UKBA for him. My question now is:

1. Can he apply for the EEA Family Permit so we move to the UK together? Would that be an acceptable kind of visa to apply for?

2. In case not, can he apply for the Settlement visa? please notice that Settlement visa ask for a sponsor in the UK...

As British to make use of the EEA route, you are required to have been working or self employed in another member state before returning to the UK. It's doesn't seem to be your case.

Sponsor in this case is a UK citizen i.e. you not a company. See more here.

2. I am the EEA national, but he has the job here in IReland and also the permanent job offer in the UK. And, unfortunately I am the jobless one . So can I still act as a Sponor?

3. The Settlement Visa asks for Accommodation which we still do not have there in the UK. We are going to rent soon after having the visa. How should we handle the accommodation section in the visa application?

Yes. Because you are the British citizen not him. You will need to show you both have enough savings not to become burden on the state.

I don't know much about UK immigration rules. Better to ask in the Immigration for family members forum but you can also use family or friends house to meet the accommodation requirement (check the forum on how to handle such cases).

"enough savings" may mean different things. Do you have an idea what the minimum should be? I also mentioned that he got a permanent job offer there with an annual salary of 36000 GBP, would that count as well?

You can not apply for a EEA FP as you do not qualify for one since you haven`t worked in Ireland.

You can apply for a spouse visa under the UK national law and use the offer letter as the means to existance. The saray you mentioned should be enough to get you through the visa however you will need the following things-

1. You will need to pay the visa application fees which is around Euro 700.
2. Your spouse needs to pass IELTS.
3. Show an evidence of where would you be staying in the UK.

Sorry to disappoint you but this way you aint moving to UK for atleast next 3 months.

Can you tell us what documents did you attach with the application? Did your spouse need to get IELTS?

Sorry for the late reply

My husband didn't do the language exam as he got a PhD from Italy which was taught in English. We have submitted the following original documents;

Passports- marriage certificate- letter from landlord - bank statement- letter from my husband current employer - job offer letter for my husband in the UK which states his salary and starting date- letter from university which he obtained his PhD confirming that the course was taught in English...
