Hello

I have an EEA family member visa through my husband however we are currently separated but not divorced. In June of this year my visa expires and I will have lived here for 5 years exercising my treaty rights as has my husband. I understand that I automatically qualify for PR, what is the earliest I can send in my application? Do I have to send it in once the 5 years as passed or can I send it a week, month or months before hand? Also, does the 5 years count from when the EEA family member visa was issued or from the date I entered the country?

It is best to apply for a confirmation of PR status. For this you will require your husband's ID card and evidence he exercised treaty right as a qualified person for 5 year in the UK. Furthermore, evidence of your residence in the UK will be required too.

Date you got married or when you start living in UK as man and wife. Provided he was exercising treaty rights during those period

That should be ok as it takes around 3 months, so the application will have to stay in the draws for a while

what about pre-check?
and in case the application pass the pre-check and reach case worker after completing the 5 years required with all support document not covering the last month (employer letter, pay slip, bank statment...ect)do you think it will be okey or i should send them shortly after completing the 5 years and before the case worker ask about them, thank you for your time.
