EEA application

hi,
i m living in the uk from last 7 years with my husband n now i've 3 children born in the uk.(6 n 4 years and 3rd is only 8 monthd old).
my husband came here as a student 8 years ago. but now we r over stayed from last 3 years. My father is german national.but he is living in the uk with me from last one month. he is working here as a self employed. n he is supporting me n my family financialy. my question is that can i apply as a european dependent on behalf of my father....

You may qualify under Regulation 7(1b) if you can show you are genuinely dependant on your dad. The position of your husband and to a lesser extent your children is a bit unclear. You may want to seek legal assistance for that, as there are no provision in the EEA regulations.

Obie I don't think the OP is genuinely dependent on her father who has been living with her from one month out of the last three years overstay. Since when this forum started to help people who are intentionally living illegally in the UK?

The forum is to advice people of possible rights. We are not judge and jury.

I am not convinced that someone is not worthy of an advice because they are overstayer, without first establishing all the fact of their case. Neither am i convinced you are in any position to detetmine soneone who.is genuine dependant and someone who isn't.

I am not judging anyone, I just gave my opinion. I am using a simple logic for someone being overstayer for three years on their own and being dependent on the EU family member for last one month to look for an option to regularise the stay. The detail says it all.

I can show you many posts on this forum where people are judging someone based on their situation and accuse them of anything they want. I understand it takes a very strong reason for someone to overstay with three kids and do not disrespect that. But I felt if the OP was genuinely dependent on her EU father she would have realised it long ago and not when she started looking for options.

To replay me obie and newbieholland.Iam genuine dependent of my father.but my father lives in Germany last 20 years he join me last month.and i don't know i am apply as a eea dependent. i went to my solicitor during meting i said my father is German national and he join us last month.he said u can apply as a dependent of u father.i said how much u charges. he said around 4000 pound.i dont have 4000 poud some body told me why not you go to immigrationboars.com and get your solution. so if you help me vary thank full to you.
