i have one query regarding my eea family permit

my eea family permit has expiry date of 08/07/2012

i know it is multiple entry visa with right to work


we are travelling to uk on 17/06/2012

now my visa will expire within one month of travelling. can i be able to work with expiry date of my FP???

as me and my wife(french national) both would be unemployed at that time...so what do u suggest for it???how should i manage it???

plus my wife(french national) is also expected nowadays she will be in her 6th month on arrival..this is another prb for me

Hi Adil

When you are in the UK on your fp then ( you don't have to) you can apply for a residence card which is valid for 5 yrs and allow you to work.

for first 3 months of entering the uk your wife need not to exercise the treaty rights but after 3 months she will need to other wise you will oonly be able to apply for PR when she will complete her 5 yrs in the uk exercising her rights.

so have Comprehensive insurance asap. Your PR depends upon your eea partner wholly

An EEA Family Permit would in this instance would usually be issued for 6 months and allows unrestricted employment in the UK for the duration. In the course of those 6 months it is expected the EU citizen applies for a Residence Permit (if not already held) and their spouse/partner applies at the same time for a Five Year Family Permit.

My understanding is that the 6 month validity applied to its use when travelling to the UK. The FP has no expiry date if the holder is in the UK and the situation that give rise to the granting of the FP has not changed.

However, if after the FP has expired and the holder leaves the UK, another FP would need to be obtained before travelling back to the UK in order to restore the holder to their previous status.

Is that correct?

The family permit does have an expiry date and like you say you could not use it for travel back to the UK if it's expired.

It can be difficult for a non-EEA family member to demonstrate to an employer, etc that they have a right to work without having a certificate of application, residence card or permanent residence card.

I'm not sure what you mean by your wife will be in her 6th month. Is she already in the UK? What is her situation, is she seeking work?

punjab you mean that i can enter the uk before expiry period of FP and then the clock for 6months period will start...

she would not be able to do the job initially till she delivers the baby and a month or two afterwards....but if there could be a possibility of home based job she can do it while sitting at home...do you know anything about it??

CSI should be before we land in uk at least for a year what do you suggest about it???any knowledge about the companies giving it in affordable price???

and i am going to apply for plab exemption in this month Insha Allah hopefully i get within one month of arrival then only i can get a job in the meantime any job would suffice

she is pregnant and at that time her pregnancy will be of 6months

and she is unemployed and on arrival we will both be unemployed...so a difficult situation till either of us get a job and we apply for CSI...any idea about affordable CSI

I've no experience on CSI. Hopefully someone else will be able to guide you on that. It's a huge step coming to the UK with a young family and no job lined up. I wish you luck with that.

The EEA FP is very useful in proving that you have a right to work.

You can certainly apply for a new EEA FP so that you have proof of your ability to work during the first 6 months of your residence.

I will start to earn asap but any job would suffice and the main thing is my clinical attachment...i will try to manage both of them...as i told you my scenario... What is the advice?

There is no problem applying for a new EEA Family Permit even if you have a valid one. Assuming you are still abroad, you can apply again with the same evidence as before. This will give you a few more months of evidence of your right to work in the UK. Once in the UK, you can apply for a 5 years Residence Card.

Your previous application took just a week so would be safe applying now if you travel in two months.

But i was thinking that the fp would allow me to enter uk and then six month clock will start...so nothing to worry about if i go with this fp...did you mean to say that its better that i should apply for eea fp as i can show employer that i have right to work?

Your existing EEA Family Permit will expire in July. There is no 6 months clock that starts once you enter the UK. Under EEA regulations, there is no requirement to hold residence documents. Your rights are derived from your relationship to a EEA national and you don't need a visa / permission from the HO. However, it is advisable to have residence confirmation document from the HO to show to employer.

If your employer would be happy to employ you based just on the (soon to expire) EEA Family Permit or they would be willing to keep you employed while you apply for a 5 years Residence Card (takes a few months), that's great. But many employers won't be so understanding.

So according to my situation do u advice me to make another application...till my 6months eea fp which if issued in may continue till november be a better option and also my eu spouse could be in a situation to do a job till november hopefully

I do not think that anyone here can give you professional advice. You can hire a lawyer if you need that.

But if I needed proof that I could work for the whole first six months in the UK, then I would apply for a new EEA FP!
