Tier1 dependent-Ex Intra company transfer-National Insurance

Hi All,

I am a Tier-1 dependent for last 2 years, but worked in UK on intra company transfer (Work Permit) for 4 years in the past during last 10 years.

I am in the process of applying National Insurance number now, though I worked in the past in UK I never had national insurance number (AFAIK) as my Indian out-sourcer never provided me P60 or any info.
In my DWP form for NI I filled up my past stays in UK & purpose as required.

Questions:
1. Since I worked here more than 4 years will they ask me to pay NI contribuition for that period now..? I donot know my Ex-companies paid NI on my behalf or not as I never got any records of that.

2. For a short period during Tier-1 dependency I used an Umbrella company which provided me P60 with temporary NI number. Will this be there in DWP records as its only temporary NI..?

3. Or DWP is interested only to verify my current Visa proof which I am sending with application..? Will they bother abt my past NI/WP etc..?

NI contributions are reflected in the payslips. Whether your employer (and you) should have made NI contributions or not depends on the how your eanings in UK were classified to HMRC by your employer. It is not unusual for overseas employers to use loopholes in the system to save on paying taxes. Nevertheless, reading National Insurance will help.

They will have it in the records for sure. But whether it can be traced to you or not is another story!!

I believe HMRC / DWP is not only concerned about your eligibility to work in the UK but also about whether you've been paying your dues as per law if you've been working.

None of my payslips during WP period says abt NINO, all are paid as Living allowances. Hopefully so DWP will not trouble me.

Did any one come across cases were people working in UK for 3/4 years still with out NINO due to the way outsoucers deal with it..??

In those cases will DWP see employees responsible for any penalties..?

Any one here know cases of National Insurance number rejection due to cases other than his/her eligibility to work in UK...???

Once you are a Permie staff I suppose its employer's responsibility to make NI contribuition right..?

While I am no expert on tax matters, but as far as I know:

1. NI contributions (for an employee) is deducted at source from employee's salary and deposited by the employer. In other words, an employer's responsibility.
2. If you're being paid only "living allowances" perhaps that is why there was no legal requirement for your employer to pay/deduct NI contributions.

Hopefully, experts on the matter will correct me if I am wrong in what I have stated.
