dual citizen Australian/Polish wanting to marry US citizen

dual citizen Australian/Polish wanting to marry US citizen

I am an Australian citizen also hold Polish citizenship.

I would like to marry an American woman, in order for me to be able to go live with her and her child in England.


If she comes over to Australia and I marry her using my Australian passport will this be seen as her being married to a EU citizen ??

or will it only work if I marry her in Poland using my Polish Passport etc. ?

1. If the marriage is valid in Australia, it will normally be valid in the United Kingdom.

2. If you want to live with your American partner in the United Kingdom, youwill need to sponsor her for an EEA Family Permit: http://www.ukvisas.gov.uk

3. Can she prove she has sole custody of her child and the right to remove that child from the U.S.?

4. You need to know that you and her will be eligible for permanent resident status after five years in the United Kingdom. You'll be able to apply for British citizenship one year after that.

Consider strongly sorting out British citizenship before thinking about moving to another EEA state. You would be able to sponsor them for a visa in another EEA state. However, if they "hop" from one EEA state to another, they will end up without citizenship from any of them. You may also want to get a British passport of your own to go with your Polish one.

because then I would lose my Polish passport.

my main question is; if we marry in Australia, will this marriage be valid to an EEA Passport holder(my polish passport)... so I can go live in England using my Polish passport, and her with me as the spouse of an EEA citizen.

A: NO. A Polish citizen can only loose his/her citizenship if she/he submits to the President of Poland specific declaration and receives President’s declaration of renunciation.


Maybe look into this a little more closely with the Polish authorities.


And presumably your wife and her child would like to have British citizenship, at least.
