Spouse(FLR M) application from uk

Hi all.
I have overstayed 14years. I do not have any criminal offences and I have never been picked by the UKBA.
My partner(british citizen)and I been living together for 2years and in march 2011 we had civil marriage.
we now have a little girl together who is 1.
We have submitted an FLR (M) in April 12 but they have sent it back saying they have lost the photos of my wife and I.
I am now going resubmit the application with new fees and photos.

Does anyone know how strong our case is and what sort of timescales they are working at ?

Or even any words of Wisdom?

Either it will be refused, or refused in the limited leave to settlement category under which you applied, but with a grant of DL instead. If you get DL you should immediately apply for ILR based on long residence.

Lucapooka, you are very certain it will be refused.
On what bases do you feel it will be? What app would you have recommended we submitted instead in the first instance.

Well, you have not said on what basis you applied. If you applied within the rules for FLR as the spouse of a British citizen, it will be refused as you don't have valid leave. If you applied outside the rules for DL on the basis of your family life, then it may be considered. My comment was based on the former type application rather than the latter but with the caveat that sometimes, instead of an outright refusal, a grant of DL is automatically awarded in lieu.

if u can prove that u have been in uk in the past 14 yrs so u might

be able to apply for ILR.

if not then I guess it is better to speak with good solicitor about ur case.
