I have a querry regarding my wife's visa. Would appreciate your advice please.

My wife came as a Dependant Tier 1 visa in May 2010. In order to work as a doctor in training, she moved to Tier 2 in August 2011 (as she couldnt work as doctor in training as a Tier 1 dependant). In December 2011, I got my ILR.

We are planning for her to apply for spouse visa - FLR(M) so that she can become dependant on me again and reduce the time for her ILR.

- I am not sure whether I have to show 6 documents to prove we have been living together for 2 years.

I am finding it difficult to find 6 documents proving that we have been living together. We have bank statements, driving licences, letters from GP and letters from letting agencies confirming that we live together. My letting agreements/ council tax/gas-electric-water bills have either mine or her name.

Please advise whether I need to provide these documents now. If yes, what other documents can I show.

I wasnt aware of these requirements hence havent kept documents/ appointment letters from GP etc.

Please help.

Thank you for your reply.

I have been on the page you have mentioned all day today especially section 11c.

It mentions if you have answered 'NO' to answer 4.1, then you need to show the documents.

section 4 we have ticked the option: "Spouse of a person present and settled in the UK and biometric immigration document".

Question 4.1 asks: "Is this the first time you have applied for a visa or extension of stay in one of the above categories (but not as a fiance(e) or proposed civil partner) with your current partner?". We have answered this part as YES, because my wife was earlier on Tier 1 dependant visa and never been ILR dependant (spouse visa).

My thinking is that my wife will be applying for this category of visa for the first time and hence we do not need to show the documents as mentioned in section 11c - second paragraph.

Hence my initial querry. I would be really grateful for your advice whether I am ticking the right boxes and am on the right track.......... May be I am completely wrong!

That thread was really helpful.

So am I right in thinking that because I have ticked yes for 4.1 then I dont need to produce the 6 documents ? (showing that we have been living together for the last 2 years).
