I am Japanese and my UK spouse visa runs out on September 19th.
My husband is a British citizen and we have been living together in England ever since we married and moved to England together in 2010. We met in 2005 have been together nearly 7 years all told.
We have a son who was born in Kent, England in July 2011, he has a British passport, and the three of us have since been living happily together.

I do not work as my husband supports me while I stay home and look after our child.

We cannot apply to extend our spouse visa via FLR(m) form as my husband's £18,500-a-year pre tax salary falls below the financial threshold by £100. We have no savings or other income

We cannot apply va the FLR(o) form because, despite speaking fluent English, I do not have a UKBA approved English test and cannot take it in time. Results can take more than two weeks.

At the moment my only choice is to overstay or face being sent home without my husband or BOTH. I currently in the early stages of pregnancy and fear the impact a long haul will have on my pregnancy.

What can I do?

If you do apply for further limited leave rather than ILR, you will be considered under the previous immigration rules rather than the new ones. However, you still need to pass an approved English test for this application.

Why would I be considered under the previous rules, I thought if i applied after july 9, it would be under the new rules.

Is there any way of a taking the english test quick?

Try and contact training connect college in hounslow. they provide result for extra £50 for urgent cases. (I am not sure but you can try it)

If you are already in the UK as a partner with a view to settlement, and wish to extend your leave in that same category, you will continue to be treated under the previous rules. However, you can't apply for FLR(M) without having passed an approved English test.

Why are you talking about applying for further limited leave and not ilr? Have you taken the life in the UK test?

I have not taken the life in the uk test, don't you need to have been in the country for 5 years. Besides we need to translate our wedding certificate as we were married in Japan

if you were issued a 27 month spouse visa in 2010 then you only need to complete 2 years before being able to apply for ilr as you are subject to the pre 9th July rules.

Presuming you were married before you were issued your spouse visa you don't need to provide your marriage certificate again with your application for ilr.

Would suggest you find out about taking the life in UK test as i am sure you will be able to do so before 19th September.
