Hi,
My wife will apply for her leave to remain in Uk but we are a bit worried about accommodation because we live with my parents and their home is on public funds. Can i use this accommodation or need to rent/own another home?

For accomodation, you need to make sure that you can provide evidence that it will have enough space and parties to the property are in agreement to accomodate your family.

Having a council house could work but it is not easy. In order for it to work you need:

- Detailed report on the size of the house and the members living in the house. To avoid overcrowding, the same thing you used possibly for her spouse VISA.
- Council to provide no objection letter for your wife to remain in the house.
- You and your wife should be paying the required rent rather then using the housing benefit scheme. It does not matter if your parents are getting benefits, your wife and you cannot.


If you go and rent somewhere else:

- Again full report to avoid overcrowding
- Landlord letter to agree with your wife staying at the property

Of course you can live with them if all the required documents can be arranged.

If you are renting privately and your parents are getting Housing benefit, that would be the easiest scenario as this was the same with me as well. When renting privately you can easilly ask the lanlord or letting agency to allow for your partner to join you and they can very easilly confirm in writing as well.

However if this is a council house, it is far harder to get a confirmation as no objection letter for your partner to join you in the property. So, I would say if you have a issues with this you should consider renting a place seperately and you need to make sure that the tenancy will have around 6 months remaining at the time of the application for good measures.

You need as evidence:

- AST (Assured Shorthold Tenancy agreement)
- No objection letter from agency/landlord, it would also help if they can add in more details on your living arrangments and monthly rent figure.
- Proof of rent (bank stements showing entries should be enough or rent book if any)
- Report on your accomodation to comply with overcrowding rules
