Spousal visa

Post by amigo4444 » Tue Mar 12, 2013 8:10 pm

Hello,
I am a British citizen awaiting a spousal visa. I have a small proble, having been made redundant from a fairly high salary, I am now working part time, earning under £10,000 per annum. However I have saving of £30,000. Would this suffice or there would be problem ahead? I would be very grateful for any advise. Many thanks,

Amigo

Have you already applied and were you redundant before you applied?

spousal visa

Post by amigo4444 » Wed Mar 13, 2013 7:34 am

Hi,
I hope I m doing it right this time!
My wife is awaiting her English language certificate, having taken the test 2 weeks ago. Upon receipt, we shall apply for her settlement visa. I was made redundant about 2 years ago, but am in part time employment now earning around 10k per annum. However, I have saving of £35,000. Would this be sufficient? I would be grateful for any advise.

At a £10k salary (note you'll need to have been employed for 6 months at least) - you have a shortfall (assuming no children) of £8.6k.

The formula to calculate how much savings you require is:

(shortfall * 2.5) + 16000

So in your case - you need £37,500 in savings, in your account for 6 months prior to application.

So I'm afraid your £35,000 is insufficient.

Does your spouse have any savings too - her savings can count into this equation?

I also note your savings have risen by £5,000 since the last post - which is correct?

M.

Hi M,
Thank you so much for your advise. Yes the extra 5k is in my current account, therefore the 35k is a true figure. However, something new has come to light. I have been going through Home Office's ''Statement of Intent'' on family migration. I came accross point 91:
91.
An applicant whose sponsor is in receipt of any of the following disability-related benefits will be exempt from the financial requirement in respect of that application stage:

Disability Living Allowance.

Severe Disablement Allowance.

Industrial Injuries Disablement Benefit.

Attendance Allowance.

Carer’s Allowance.
92.
The applicant will be required to demonstrate that they will be adequately maintained and accommodated without direct recourse to public funds. The new financial requirement will apply at the next application stage if the applicant does not remain exempt from it.

Well, I have been in receipt of Disability Living Allowence since 1980.
Does this gets me off the hook?
Regards,
Amigo

Financial exemption under disability status

Post by amigo4444 » Wed Mar 20, 2013 7:08 pm

Hi, sorry to bother you again, but I am a bit worried about some new changes people are talking about with regards to exemption for the financial part for a disable person.
1. Are there any new changes proposed to this exemption that may effect my wife's application?
2. If I apply for a new job at a high salary and am successful, would that effect the 6 months period that I should have been with an employer.
Would be very grateful for your comments.
Regards,
Amigo
