Spouse of person with Refugee Status, which form to use?

Good morning Amber,

My nephew has been studying in the UK for two years on a student visa. He recently married his girlfriend whom he had been dating for one year. His wife has 5 years Refugee status and eligible to apply for ILR in another one year. My nephew would now like to switch, which application form should he use and are there any requirements he would be expected to meet such as required when applying under Appendix FM.

As my nephew's wife is not a settled person yet as she does not currently have ILR, would this pose a problem?

For FLR(O) I believe that it would be necessary to show that the applicant formed part of the family unit prior to the sponsor having fled their country of origin to claim asylum in the UK.

Perhaps FLR(M) under Appendix FM. The standard rules should apply.
