FLRM with a British Citizen Spouse

Post by purple80 » Tue Aug 19, 2014 2:22 pm

Dear All

After looking at the various posts and forums, I was not able to gain clarity on this. So I am asking for some assistance here:

I have been in the UK since 2006 Oct, firstly on a Student Visa, then PSW for a year and then on Tier 2 general through a COS from my employer. Now, I wish to change my Tier 2 general to a spouse visa on the basis of my spouse's british citizenship by birth. We got married in Sep 2013 and have been living together since then.

Will this be straight forward, I have almost all documents and conform with the minimum salary required as well. One thing, we have a religious marriage certificate as the ceremony took place in a temple in India. We get most of our bills on individual names and we do not have anything coming in joint names. Please suggest regarding documents which we can provide to state our subsistence together.

Could any of the moderators, kindly elaborate on the process after the recent change in rules for this route.

Any help will be immensely appreciated and I thank you for your time in advance.

Regards
BPS

You could switch, but then you will have to wait till 2016 to obtain ILR on the basis of long residence.

Whether this is shorter or longer than your current route is unknown to me.

I suspect your India Temple wedding will not be recognised, but if you have been in a relationship akin to a marriage for two year, then you may qualify.

Thanks for your prompt reply.

The 10 year route will be shorter this way.

Regarding the certificate, it is from a certified body that governs all temples in the state. Due to lack of time we could not apply for the government one, and now its extremely difficult to go back and get one.

Also, could you please comment on documents which are common to both of us.

Thanks again!

Thanks for the limited help provided on the question. However, some of the information available at the forum was useful. The application was successful.

Thanks
