Immigration for my Wife with my previous Tier1G dependent vi

Post by gaminhas82 » Tue Nov 18, 2014 2:22 pm

Hi guys, i need your help please!!

I would like to apply for my Wife's extension who is still on my Tier1 dependent visa, while I got my ILR 6 months ago on the basis of 10 years. Here is my synopsis:

I came to the UK in Feb 2004 as a student
My wife joined me in OCT 2006 as my dependent
First Child born in 2008 (got his dependent visa)
I got psw in 2008
Got Tier 1 general in 2011 and also got my wife and son on my Tier 1 dependent visa.
Another child born in 2011 and got him as my dependent on Tier 1 General
2013 got my extension as Tier 1 general and got wife and children as my dependents.
May 2014 I got my ILR on long residency basis, Got my children registered as British...
Wife is still on Tier 1 general Dependent visa which will be expiring in May 2016 (with Only 5 months difference when she could become eligible to apply for her ILR on 10 years basis in Oct 2016).

I am very confused as if I apply for her as FLR m, then the time spent (9 years 6 months will be reset???). Please advise me what category she should apply to change her status from my previous Tier 1 general to either my dependent or something else so that she may be get ILR quicker.

I would be very grateful of your help..

Because you obtained ILR through long residency, your wife needs to switch to FLR(M). The rules changed in April this year, see link below :

Switching to FLR(M) visa WILL NOT reset her clock for ILR based on 10 years residence and once she reaches 10 years with any legal visa status she can still apply for ILR on form SET(LR).
