Should I appeal? Category A - Spouse Visa

Post by Smurf786 » Thu Nov 27, 2014 10:26 pm

Hi,

My application has been refused as my 2nd job was being paid cash. There was deposits in the bank account but did not show the exact salary amount being deposited. Having 2 jobs around my life it is difficult to find time to go to the bank to deposit the money.

Should I appeal or wait 6 months and re-apply?

What can I provide to support my appeal?

I have paid my taxes and feel i am being treated unfairly as they could see from HMRC my taxes have been paid?

Any help would be appreciated.

Many Thanks....

You could appeal. If indeed you work and get made, the mode of payment should not put you at a disadvantage, especially if there is evidence that the work is legitimate and taxes has been paid.

Thanks obie for the quick response. They have stated that:

Under paragraph 1(n) of Appendix FM-SE the gross amount of any cash income may be counted where the person’s specified bank statements show the net amount which relates to the gross amount shown on their payslips (or in the relevant specified evidence provided in addition to the specified bank statements in relation to non-employment income). Otherwise, only the net amount shown on the specified bank statements may be counted.

I was never aware of this otherwise would have deposited exact amounts...

What could i state in my appeal that will help?

Thank You

That's where you may struggle because it's been made explicit what those paid cash in hand must do.
