Sponsoring Member of Family (Brother)

Post by cisman » Thu Apr 02, 2015 7:11 pm

Hi Guys

Wondering if you could offer some help with a question I have.

I am a naturalised british citizen and would like to sponsor by brother who is currently living in Pakistan. He has was here for a while to complete his studies and went back couple of year ago after finishing his University.

Unfortunately the economic situation in Pakistan is not great and despite of having a good degree he has been struggling for a while. I have been financially supporting him for the past few months to make ends meet. He is not married and about 33 years old.

Is there any provision in British or Irish law that would allow me to sponsor him ? If yes, what documentation is required and how long does the process take ?

Your advice would be greatly appreciated.

Many thanks

Unfortunately, you will not be able to sponsor your brother on the grounds that the economic situation in Pakistan is bad.

As he is 33, he would need to apply for an Adult Dependant Relative visa, the conditions of which are quite strict.

https://www.gov.uk/join-family-in-uk/eligibility
You’re an adult dependent relative
You must be dependent on a parent, grandchild, brother, sister, son or daughter of someone living permanently in the UK.

You must prove that:
  • you need long-term care to do everyday personal and household tasks

the care you need is not available or affordable in the country you live in

the person you’ll be joining in the UK will be able to support, accommodate and care for you without claiming public funds for at least 5 years

    you’re 18 or over
On these forums, only 2-5 cases have been known of these visas being issued in the past three years and they have typically been for parents who live in countries where healthcare is not affordable, such as the US.

What you can do is try to get a job for him here (in the UK or the EU) through companies that can provide him with a work (UK Tier 2 or EU Blue Card) visa.

Alternatively, you could move to Ireland (or any other EU country) and get him to the EU through the Surinder Singh route (Google it for more information). But that requires you to move the center of your life (your estate, bank accounts, etc), to the other EU country.
