Post by sherb » Fri Apr 24, 2015 9:14 am

Hi,

i have received my entry clearance as a spouse, but i need to apply for my daughter who is 12 year old from my earlier marriage.i have sole custody of the child which is mentioned in the divorce decree and i have been taking care of her. her father does not have visiting rights or anything as such.
i want to know how to apply for her visa , i had mentioned her as my dependent on my application and said she would be travelling with me. but not sure which form to use and how can i apply. please help me !!

Why didn't you apply for the child when you applied for your visa??

You will have to follow the same process you did for your visa. It would have been much easier if you had both applied together.

You will also have to pay the new NHS surcharge for the child, £200 per year payable upfront at the point of application for the duration of the visa (£200 x 3 = £600).

Is your sponsor earning up to 22400, provided of course there is no other children in your household who is not a British or settled.

i have full custody of my daughter and i have enough documents to prove that she is staying with me and I'm taking care of her schooling and other expenses.do i still need a letter of consent from her biological father?
she does not meet him regularly as we stay in different states. maybe meets her twice in a year.

A letter of consent from child's father may imply that you don't have sole responsibility and defeat the purpose.

Thank you so much. I have the appointment scheduled for next week and while going through the site I read that letter of consent is required. I was tensed.
Thank you for the reply. I have an additional document from the court saying I'm the legal guardian. That was applied while getting her passport.

It is not difficult to have an EEA FP if you get all documents right. You must provide proof of relationship with the sponsor( Your marriage certificate), dependency ( remittances to the child/legal Guardian, The child's birth Certificate, TB test results and a letter of consent/ Affidavit from your ex husband giving his consent to your EEA husband and yourself for child to come and join you.

We did this for my 4 step children in February and they got their visas in three days. My husband only had his RC in January.

Good Luck.
