Joining family when someone is guardian

Dear All,

I am in a very tricky situation.

Me, my wife and daughter are here in UK and we have obtained the british passport.

Our son is in India and his indian passport has expired and visa to UK has expired too. Now we want our son to be with us and there fore we are trying to renew his indian passport.

The proble is that indian passport office is demanding the legal guardianship from my brother whom we have given the authority to apply for renewal of indian passport for my son. Without that the indian passport office is not renewing the passport of my son.

If I allow my brother to have legal guardianship then my son's passport will have my brother's name in his passport.

Now I think that his might be an issue for the application of visa from india to uk.

Please let me know the solution.
