Hello, and thanks for taking the time to read this, any advice would be very grateful. My Girlfriend is Filipino, she has lived and worked in the UK for 10 years, she has paid her taxes all that time, and has never been in trouble or claimed benefits..The bad news is she left her job because of illness, and has overstayed approx. 1 year and has returned to the phillipines, she has been gone now approx. 4 weeks, can anyone give me some advice on the process of trying to get her back. Thanks for your help. :(

Suggest you double-check but if the lady left this country voluntarily it seems she cannot reapply for any UK visa for at least one year.

If you are applying for a fiance visa to marry in the UK then there will be no ban under 320(7b). She could face a discretionary refusal under 320(11) if she 'frustrated the Immigration Rules'

Are you earning a minimum of £18,600 per annum?
